The petitioner Thiru A. Rajaram, was present for today's (26-4-2010) enquiry. The Public Authority was represented by the Public Information Officer, Tmt A. Yasmin Begum, Assistant Commissioner of Labour, Office of the Deputy Commissioner of Labour.I, Chennai. 2. Under Section 6(1) of the Right to Information Act, 2005, the petitioner sent an application dated 24-8-2009 addressed to the Public Information Officer, Office of the Commissioner of Labour, Chennai, seeking information on five items with regard to the Deputation/Tranfer made in Labour Department. The PIO sent reply to the petitioner on 23-9-2009. Not satisfied with the reply of the PIO, the petitioner filed the first appeal under Section 19(1) on 25-9-2009 to the appellate authority and the second appeal under Section 19(3) to the Commission on 14-11-2009. On the basis of the second appeal to the Commission, both the petitioner and the Public Information Officer, were summoned to appear before the Commission for today's hearing. 3. During the enquiry, the petitioner stated that the correct and complete information was not given on all items by the PIO. The PIO informed the commission that the information given to the petitioner was available with the Government records. Regarding item Nos. 1 and 2 the PIO has stated that the connected records are not available with them. The information asked for by the petitioner and the information supplied by the PIO were examined in detail. At the end of the enquiry, the Commission comes to the conclusion, that for item No.1 and 2 (Copy of reply affidavit filed to the O.A.No.6347/2002 on the Hon'ble Tribunal, Chennai and to the W.P.No.3587/2003 on the file of the High Court, Madras) an sworn affidavit may be filed before the Commission. For item No.3 and 4, a revised reply be supplied to the petitioner, For item No.5 the information is supplied. Hence, the Public Information Officer, Office of the Commissioner of Labour, Chennai, is directed to give an affidavit ( Rs.20/- stamp paper ) for item Nos. 1 and 2 and for item No.3 and 4 correct and complete information based on the records be supplied to the petitioner within two weeks from the date of receipt this order and send a compliance report to the Commission within three weeks. Orders approved on this the 4th June, 2010, Under the Orders of the Commission Case No.30017/2009
